Carl Schmitt unterhielt zeitlebens eine beeindruckend umfangreiche Korrespondenz. Seine Briefpartner waren höchst unterschiedlich. Es zählten dazu sowohl Künstler, wie Gelehrte aller Art, insbesondere juristische Kollegen als auch sonstige Persönlichkeiten.Ein Teil seiner Korrespondenz, nämlich die mit Ernst Jünger und mit Armin Mohler wurde in den letzten Jahren bei Klett-Cotta bzw. dem Akademie-Verlag veröffentlicht. In unserem Hause erschienen 1989 Briefe an Carl Schmitt, die der langjährige frühere Leipziger Studentenpfarrer Werner Becker in den Jahren 1923-1978 an Schmitt gerichtet hatte. Die (...) Schreiben Schmitts, die sich leider nicht mehr erhalten haben, erschließen sich insoweit, als Becker darin auf vorangehende Schreiben Schmitts inhaltlich eingeht. Im Dezember 2003 erschien in der Festschrift für Werner Krawietz unter dem Titel »Legalität, Legitimität und das Politische - Ein Briefwechsel« eine von Florian Simon aus unserem Verlagsarchiv zusammengestellte Korrespondenz Schmitts, die dieser in den Jahren 1931-1933 mit Ludwig Feuchtwanger, in den Jahren 1913-1936 wissenschaftlicher Leiter unseres Hauses, geführt hat.In Spanien war einer von Schmitts intensiven Briefpartnern, der 1915 geborene Römischrechtler Prof. Dr. Álvaro d'Ors. Er kannte Schmitt anfangs nur mittelbar und zwar über seinen Vater, den Philosophen und Essayisten Eugenio d'Ors. Dieser war mit Schmitt seit 1929 befreundet und hatte ihm in seiner Schrift Glosario mit der Darstellung seines Rangs und Originalität seiner Denkweise ein Denkmal gesetzt. 1944 lernten Álvaro d'Ors und Schmitt sich auch persönlich kennen, bei Gelegenheit eines Vortrags von Carl Schmitt »Vitoria und sein Ruhm«, den dieser an der Universität von Granada hielt. An diese war Álvaro d'Ors kurz zuvor zum Ordinarius für Römisches Recht berufen worden.Der Briefwechsel zwischen Schmitt und d'Ors setzt 1948 ein und endet 1983, zwei Jahre vor dem Ableben Schmitts. Der Briefwechsel war begleitet von einer Reihe von Begegnungen in Deutschland, aber mehr noch in Spanien, und zwar insbesondere in Santiago, wohin d'Ors später berufen worden war. Dort lebte seit 1959 auch Schmitts einzige Tochter Anima, nach Ihrer Eheschließung mit Alfonso Otero, Ordinarius für Rechtsgeschichte an der dortigen Universität.Der hier nun vorgelegte Briefwechsel zeigt, wie sehr die theoretischen und praktischen Interessen beider Juristen miteinander verwoben, aber dennoch ihre Denkansätze und Ergebnisse sehr verschieden waren. Der Briefwechsel führt uns durch einen für beide Partner überaus fruchtbaren Dialog zu grundlegenden Aspekten des Denkens beider Autoren: der Nomos der Erde, die Einheit der Welt, Ausnahme und Norm, Legalität und Legitimität und politische Theologie.In sorgfältigen und umfangreichen Anmerkungen der Herausgeberin werden dem Leser Zusammenhänge und Hintergründe erschlossen sowie die in den Briefen erwähnten Persönlichkeiten vorgestellt, die dem deutschen Leser weitestgehend unbekannt sind. Die Briefe mit den Anmerkungen geben einen aufschlußreichen Einblick in das Denken der Briefpartner und insbesondere Carl Schmitts. In the Preussen contra Reich case of 1932, Carl Schmitt’s theories on equal chance and law in extreme conditions are interpreted and applied in a court of law, firstly by Schmitt himself, then, going contrary to Schmitt’s interpretation, by Dr. Arnold Brecht and Dr. Hans Peters. This paper will first present the basis of the two theories from Schmitt’s “Legality and Legitimacy,” namely, equal chance and the need for extraordinary measures. Then this paper will focus on (...) the diverging legal interpretations of these two theories, as presented in court by different legal theorists. These divergent interpretations of “equal chance” and “law in extreme conditions,” as presented in the aforementioned case, have yet to reach an international readership, as the case itself has never been fully translated into English. Finally, this paper will question the practical application of the two theories in the reality of the empirical world, which in turn question the relationship between any parliamentary legislative system and law. In 19th Century Transkei, crowds would gather to watch whole herds of cattle charging over several kilometres in the popular sport of uleqo. This sport became untenable due to environmental conditions and colonial responses to those conditions. Horses replaced cattle in the racing tradition and uleqo was effectively relegated to a footnote in the history of the area. This article draws together the few remaining descriptions of uleqo in the Eastern Cape. It does so to ask two main questions: what (...) can we learn about uleqo's exclusion? And, what might including the remnants of uleqo offer? In answering these two questions this article will draw upon the idea of an 'artefact, which is simultaneously a remnant and a defect in an image. Here, 'artefact' is used also to refer to archival fragments, and to the distortions that ignoring them may have produced. By focusing on uleqo, it is argued, we can appreciate some neglected ways in which the people of the now-Eastern Cape altered their daily practices in response to the colonial project. (shrink)

SummaryThis paper analyses the revival of Pliny's Naturalis historia within the scientific culture of the late eighteenth and early nineteenth centuries, focusing on a French effort to produce an edition with annotations by scientists and scholars. Between the Renaissance and the early eighteenth century, the Naturalis historia had declined in scientific importance. Increasingly, it was relegated to the humanities, as we demonstrate with a review of editions. For a variety of reasons, however, scientific interest in the Naturalis historia grew in (...) the second half of the eighteenth century. Epitomizing this interest was a plan for a scientifically annotated, Latin-French edition of the Naturalis historia. Initially coordinated by the French governmental minister Malesherbes in the 1750s, the edition was imperfectly realized by Poinsinet a few decades later. It was intended to rival two of the period's other distinguished multi-volume books of knowledge, Diderot and D'Alembert's Encyclopédie and Buffon's Histoire naturelle, to which we compare it. Besides narrating the scientific revival of the Historia naturalis during this period, we examine its causes and the factors contributing to its end in the first half of the nineteenth century. The study aimed to identify the concept of sustainable development, and to explore the role of digital libraries in achieving SDGs, by shedding light on the reality of the SDL in terms of financial, technical and human capabilities to achieve the Kingdom’s 2030 vision for sustainable development. The study revealed that digital libraries play an active role in achieving SDGs through secure and diverse technical infrastructure, and a variety of digital information sources. Digital libraries enhance the level of information awareness (...) among users. Among digital libraries worldwide, SDL is distinguished in terms of knowledge resources acquired, its platforms, and through the large number of beneficiaries of its services, representing all segments of the academic community in Saudi Arabia's higher education institutions. Based on a solid network, and Saudi Arabia vision 2030, SDL succeeded to link higher education institutions through a huge amount of information sources, and facilitated their access, and provided equal opportunities for all. The study recommended that in order to be the national digital platform and effective development partner, SDL must expand the scope of services to include trade and industrial private and public sectors, and raise the level of research awareness and ethics among Arab scholars and researchers. Liberal nationalists have been trying to argue that a suitably sanitized version of nationalism—namely, one that respects and embodies liberal values—is not only morally defensible, but also of great moral value, especially on grounds liberals should find very appealing. Although there are plausible aspects to the idea and some compelling arguments are offered in defense of this position, one area still proves to be a point of considerable vulnerability for this project and that is the issue of what, according to (...) the liberal nationalists, we owe both members of our nation, our co-nationals, and what we owe those who are not members of our nation. It is here that we see the project still has some distance to go if a version of liberal nationalism is, indeed, to be morally defensible. In this paper I examine leading liberal nationalist accounts of our obligations to co-nationals and non-nationals. I argue that liberal nationalists have not yet given us an adequate account of our obligations to non-nationals for a number of reasons. For instance, on the issue of the priority we may give co-nationals' interests over non-nationals', the theorists' view show significant tension, they seem to be confused about what their positions entail, the views are unhelpful, ad hoc, or the positions are quite unclear. Liberal nationalists also have a misleading impression that their positions better capture the relation between personal identity and duty, but this turns out to be false. Other defects with their specific projects are highlighted. I go on to offer a more promising method for determining our obligations to non-nationals. Rather than this alternative precluding any scope for nationalism, it actually makes clearer to us how there might be some defensible space for nationalism once our obligations to put in place appropriate institutions and sets of rules have been fulfilled. Olivier Pelon et Anne Schmitt Étude en laboratoire des céramiques dites de Vassiliki (Crète orientale) p. 431-442. La céramique minoenne dite de Vassiliki est datée du Minoen Ancien II et se rencontre sur la plupart des sites crétois de cette époque ; très reconnaissable, elle se caractérise par un décor flammé constitué de plaques irrégulières, rouges orangées et noires. Pour la détermination de son lieu de production, on a procédé à l'étude chimique globale par fluorescence X, complétée par une (...) étude pétrographique, de divers échantillons provenant de Malia, de Myrtos-Pyrgos, de Myrtos-Fournou Koryphi et de Vassiliki même. Cette étude conduit à distinguer deux groupes de composition chimique différente. Le premier, bien représenté à Malia et à Vassiliki – ce qui autorise l'hypothèse d'échanges entre les deux sites –, pourrait provenir de Vassiliki. Le second, de facture beaucoup plus grossière et beaucoup plus abondant que le premier à Malia, est, selon toute vraisemblance, de provenance locale ; les caractéristiques de l'argile utilisée le rapprochent en effet de celle des formations métamorphiques du massif du Sélinari, à quelques kilomètres à l'Est du site. This paper sheds new light on Putnam's hypothesis that watching television, particularly entertainment programs, contributes to an erosion of social trust. Previous studies have been unable to reach convincing evidence regarding this claim. It is argued that this is a consequence of the neglect of indirect, interpersonally mediated TV effects which supplement the influence of direct exposure, and extend even to those who do not watch television. Using data from the 2002 and 2004 waves of the European Social Survey in (...) combination with aggregate data from telemetric audience research, we conduct a multilevel analysis of TV's impact on social trust. Investigating this macro-micro relationship, we find that patterns of general TV use in 25 European societies exert substantial effects on individual social trust that by far exceed those of individual TV use. In line with Putnam's hypothesis, there is a negative impact of total TV time; however, high market shares of public TV increase social trust. (shrink)

The Indus Basin's advantageous climate and topography rendered it a prime site for the implementation of an irrigation system. This study looks at how the Indus Basin is affected by climate change. Changes in water flow, glacial/snow melt, and catchment areas in the Indus and its tributaries are revealed by trend analysis from hydro-logical stations. A network of canals constituted of trans-boundary rivers was built beside the Indus River System (IRS), soon after the implementation of the Indus Water Treaty, about (...) 70% of its water was allocated for irrigation purposes. An evident increase from 8.5 to 18.2 million hectares (MH) in the cropland area in Pakistan is monitored, whereas in India it increased widely from 2.02 to 8.5 MH that is about three times of the pre-vious figures due to expansion of the Indus irrigation network. Water tables have dropped and water logging has resulted from urbanization and groundwater extraction, while the use of pesticides and fertilizers has lowered the quality of the water.These problems are made worse by climate change, which presents serious obstacles to the region's water security, environmental sustainability, and economic growth.This article provides a comprehensive analysis of the modifications in the Indus Basin irrigation system and the impact of these changes on environmental resources. We can create practical plans to lessen the consequences of climate change and guarantee the Indus Basin has a safe and sustainable water supply in the future by comprehending how it affects the basin. Carl Schmitt (1888–1985), Professor für Staats- und Völkerrecht, bewegt nach wie vor die Gemüter. Die Reaktion auf seine Schriften, Handlungen und Ausstrahlungen ist vielfältig; die Spanne reicht von entrüsteten, für die er der Teufel in Person bleibt, über viele Zwischenstufen bis zu jenen Lesern, die ihn für einen der subtilsten, noch keineswegs ausgeloteten Geistern dieses Jahrhunderts halten. Sein Leben lang war Carl Schmitt ein passionierter Schreiber von Briefen. Meist handelte es sich um handschriftlich verfasste, die für den Schreibenden (...) die Fortsetzung eines konkreten Gespräches mit anderen Mitteln war. Das macht das authentische und die Spontanität der Schmitt-Briefe aus. Als erste Edition einer umfangreichen Korrespondenz wird in dem Buch die Korrespondenz zwischen Carl Schmitt und Armin Mohler veröffentlicht. Der Briefwechsel umfasst die Zeit von 1947 bis 1980 und enthält 280 Briefe und Karten von Carl Schmitt an Armin Mohler. Von dem Briefpartner und Herausgeber wird in der Regel aus den eigenen Briefen nur auszugsweise zitiert, sofern es für das von Carl Schmitt Geschriebene notwendig ist. Armin Mohler (1920 bis 2003), ist einer der bekanntesten rechtskonservativen Schriftsteller, Kritiker und Historiker in Deutschland. Sein Handbuch zur Konservativen Revolution ist ein Standardwerk. In der Zeit des Briefwechsels war Mohler von 1949 bis 1953 Sekretär Ernst Jüngers, danach Korrespondent großer Zeitungen in Paris und von 1964 an Geschäftsführer der Carl Friedrich von Siemens Stiftung, in der er sehr beachtete Symposien zu aktuellen wissenschaftlichen Themen organisierte. Der Briefwechsel ist für die Deutung Carl Schmitts in der Nachkriegszeit in seinem Sauerländer "Exil" grundlegend, gleichzeitig enthält er pointierte Schlaglichter auf das politische und kulturelle Geschehen der frühen und mittleren Bundesrepublik sowie auf Werk und Leben von Ernst Jünger. The theoretical framework that animates these slogans, however, has remained somewhat opaque. The existence of neural correlates of consciousness (NCC) is not enough for philosophical purposes. On the other hand, there's more to NCC than meets the sceptic's eye. (I) NCC are useful for a better understanding of conscious experience, for instance: (1) NCC are helpful to explain phenomenological features of consciousness – e.g., dreaming. (2) NCC can account for phenomenological opaque facts – e.g., the temporal structure of consciousness. (3) NCC reveal properties and functions of consciousness which cannot be elucidated either (...) by introspective phenomenology or by psychological experiments alone – e.g., vision. (II) There are crucial problems and shortcomings of NCC: (1) Correlation implies neither causation nor identity. (2) There are limitations of empirical access due to the problem of other minds and the problem of self-deception, and (3) due to the restrictions provided by inter- and intraindividual variations. (4) NCC cannot be catched by neuroscience alone because of the externalistic content of representations. Therefore, NCC are not sufficient for a naturalistic theory of mind, (5) nor are they necessary because of the possibility of multiple realization. (III) Nevertheless, NCC are relevant and important for the mind-body problem: (1) NCC reveal features that are necessary at least for behavioral manifestations of human consciousness. (2) But NCC are compatible with very different proposals for a solution of the mind-body problem. This seems to be both advantageous and detrimental. (3) NCC restrict nomological identity accounts. (4) The investigation of NCC can refute empirical arguments for interactionism as a case study of John Eccles' dualistic proposals will show. (5) The discoveries of NCC cannot establish a naturalistic theory of mind alone, for which, e.g., a principle of supervenience and a further condition – and therefore philosophical arguments – are required. Ethical theories have been largely focused on finding and clarifying certain amoral principles. However fruitful the communication of moral principles for providing orientation in modern society might be, a serious omission has been made in that the problem of implementation is not addressed. Two fundamental question have neither been raised nor answered: Why should self‐interested individuals follow the proposed moral principles in their daily conduct? Are societal institutions of such a design that is in the power of the individuals to (...) follow these moral principles? It is shown in this article that an economic theory of morals does systematically address these two questions and therefore provides a firm basis for discussing the possibilities and boundaries of following the moral principles inherent in the long history of moral philosophy. This chapter addresses the distinction between private and public and the difference between ‘public’ and ‘official’. Drawing on a comparative analysis of Asian cities, it looks at the ways in which the local, the national and the global levels, which serve different, sometimes contrasting, interests, are negotiated and reconciled in the city. The chapter suggests that different forms of reconciliation have brought about an alternative ‘insitutionalisation’ of the public space. Such an institutionalisation is reflected in the access to, and dissemination (...) of, information—e.g., access to the media—and, above all, in the control over the common goods. The public sphere is used to voice discontent, leading to a new definition of the ‘common good’; that is, the inclusion, or non-exclusion, of large sections of the population which, though initially marginal, can become significant in shaping urban politics. Barsalou's theory of perceptual symbol systems is considered from a metacognitive perspective. Two examples are discussed in terms of the proposed perceptual symbol theory. First, recent results in research on feeling-of-knowing judgement are used to argue for a representation of familiarity with input cues. This representation should support implicit memory. Second, the ability of maintaining a theory of other people's beliefs (theory of mind) is considered and it is suggested that a purely simulation-based view is insufficient to explain the available (...) evidence. Loeb’s case is so compelling indeed that anyone who wants to defend an alternative interpretation will now have to assimilate or deflect the massive (...) textual evidence in favor of the stability interpretation. I will argue here that, for some passages Loeb cites in favor of the stability interpretation, a veritistic interpretation explains the text at least as well as the stability interpretation does. The Sociosexual Orientation Inventory (SOI; Simpson & Gangestad 1991) is a self-report measure of individual differences in human mating strategies. Low SOI scores signify that a person is sociosexually restricted, or follows a more monogamous mating strategy. High SOI scores indicate that an individual is unrestricted, or has a more promiscuous mating strategy. As part of the International Sexuality Description Project (ISDP), the SOI was translated from English into 25 additional languages and administered to a total sample of 14,059 people (...) across 48 nations. Responses to the SOI were used to address four main issues. First, the psychometric properties of the SOI were examined in cross-cultural perspective. The SOI possessed adequate reliability and validity both within and across a diverse range of modern cultures. Second, theories concerning the systematic distribution of sociosexuality across cultures were evaluated. Both operational sex ratios and reproductively demanding environments related in evolutionary-predicted ways to national levels of sociosexuality. Third, sex differences in sociosexuality were generally large and demonstrated cross-cultural universality across the 48 nations of the ISDP, confirming several evolutionary theories of human mating. Fourth, sex differences in sociosexuality were significantly larger when reproductive environments were demanding but were reduced to more moderate levels in cultures with more political and economic gender equality. Implications for evolutionary and social role theories of human sexuality are discussed.
